Celina Jaitley: ‘No greater injustice than Section 377 ruling’

Celina Jaitley has expressed her shock after the Supreme Court of India refused to review its December 11, 2013 ruling on homosexuality.

The Supreme Court yesterday (January 28) dismissed a plea by the central government and NGO Naz Foundation to review its Section 377 verdict, which deems homosexual acts to be an offence.

Gay rights activist Jaitely told IANS: “The honourable court has rejected the petition as it found no merit in it. No merit in it? Millions of lives are at stake and the court finds no merit in the petition?

“People with gay tendencies cannot be held guilty for going against the order of nature. Who decides what the order of nature is? To me child marriages and marital rapes are unnatural,” she added.

The actress said that the regressive ruling was a major setback for the LGBT communities in India.

“Thousands from the LGBT community came out in the open to protest when their sexual identity was challenged during the past four years. And that too after the Delhi High Court had decriminalised gay sex,” she said.

“Now the gay community is back to square one. They face the threat of being prosecuted for choosing the partners that they want. I can’t think of a greater injustice.”

Jaitley said she remains hopeful, however, that the ruling will be re-addressed.

“I hope Parliament will address the issue and all the political parties, regardless of their political and religious affiliation, will come together to uphold the constitutional guarantee of life and liberty to all citizens. And that includes those affected directly by Tuesday’s judgment.”

Bollywood’s biggest stars have spoken out in condemnation of the Indian Supreme Court’s December 11 ruling which states that gay sex is a criminal offence.

Imran Khan has fronted a campaign in protest at the Section 377 ruling.
